Member clubs are advised that clubs may temporarily convert outdoor spaces into dining areas without obtaining development consent, under a recently introduced, streamlined approval process.

Given the possibility of more relaxed restrictions in outdoor areas as hospitality venues in locked-down areas reopen, clubs may wish to consider how they can convert outdoor spaces — such as parking lots — into dining areas.

In late 2020, section 166 was inserted into the Liquor Act, which enables hospitality venues to convert parking spaces, footways and other public open spaces associated with the premises into outdoor dining areas without needing to obtain development consent. Instead, businesses can seek approval from the local council under a fast-tracked process. Read more in circular 21-147.
