Our identity and contact details

The Registered Clubs Association of New South Wales t/as ClubsNSW (ABN 61 724 302 100), being the Multi-Venue Self- Exclusion (MVSE) operator, (MVSE Operator, we, us, our) will collect, store and use the personal information you have provided to us pursuant to the terms of this Personal Information Collection Notice and our Privacy Policy.

Circumstances of collection and use of your personal information

The primary purpose for which we are collecting and using your personal information is to:

  • communicate with you regarding the MVSE application;
  • facilitate the MVSE process;
  • store your personal information in the MVSE system;
  • make your personal information, as relevant, available to the registered club(s) nominated by you in the Third Party Exclusion Contract Form and any other person or organisation assisting to provide the MVSE program or administer or enforce an involuntary exclusion;
  • assist the registered club(s) nominated in the MVSE application in enforcing the MVSE of the individual listed in the MVSE application; and
  • enable reporting purposes such as to report to relevant government department(s) and/or agency.

We may also use your personal information for related secondary purposes including:

  • to offer or provide you with counselling or other support services following the MVSE application;
  • as required or permitted by any law (including the Privacy Act 1988 (Cth) (the Privacy Act); and
  • for any other purpose stated in our Privacy Policy.

What Personal information we collect

ClubsNSW will collect the following personal information from you:

  • given name(s);
  • surname;
  • phone number;
  • relationship to the individual you propose be excluded from nominated venue(s) (including if you are submitting the application on behalf of a member club);
  • email address;
  • address; and
  • IP address.

Consequences if personal information is not collected

Unless you are a registered club, providing us with the requested personal information is not required by law. However, if you do not provide us with the personal information we ask for, or the information provided is incorrect or incomplete, you will not be able to complete the Third Party Exclusion Contact Form or access our third party exclusion process and we will not be unable to contact you to respond to the information you submitted through the Third Party Exclusion Contact Form.

Disclosures of your personal information to third parties

We may disclose your personal information to the following organisations for the purposes described above (as well as otherwise permitted or required under Australian law):

  • each of the registered club(s) nominated in the MVSE application;
  • if you have submitted a MVSE application on behalf of a registered club noted in the MVSE application, we may disclose your personal information to that registered club;
  • any other person or organisation which helps us to provide the MVSE program or enforce the MVSE for the purpose of administering or enforcing the MVSE;
  • our related entities;
  • our directors, employees, contractors and external service providers (and those of our related entities);
  • to any person or entity that acquires, succeeds to, or assumes responsibility for the MVSE Operator or the MVSE program;
  • as required or permitted by any law (including the Privacy Act);
  • law enforcement, government department, agency and/or regulatory body; and
  • any other organisation as covered in our Privacy Policy.

Disclosure of your personal information to overseas recipients

It is unlikely that we will disclose your personal information to any recipients that are based overseas, however to the extent that we do (for example third party cloud storage providers and other service providers), we have taken reasonable steps to ensure that any overseas recipient of your personal information complies with the Australian Privacy Principles made under the Privacy Act. By providing your personal information, you consent to any such disclosures where reasonably necessary for the provision of services and subject to appropriate safeguards.
